Terms of Use
1. Acceptance
These terms are an agreement between you and Individual Entrepreneur Aleksandr Senin, registered in Georgia under identification number 336055413 ("we", "us"). By downloading or using the FocusAlly app for macOS or iOS ("the app") you agree to them. If you do not agree, do not use the app.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in accordance with Apple's Usage Rules for App Store content. You may not sell, rent, sublicense or redistribute the app, and you may not reverse-engineer it except where that restriction is prohibited by applicable law.
3. Accounts
FocusAlly can be used without an account; your data then stays on your device. Signing in — with a one-time email code or with Sign in with Apple — enables synchronisation between your devices and the server features.
You are responsible for keeping access to your device and to the email address or Apple account you sign in with. Anyone with access to those can reach your FocusAlly data.
4. Subscriptions
FocusAlly offers an optional paid subscription with weekly, monthly and annual plans. All plans unlock the same set of paid features.
- Billing. Payment is charged to your Apple Account at confirmation of purchase. Prices are shown in the app before you buy and vary by storefront.
- Auto-renewal. The subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends. Your Apple Account is charged for the renewal within 24 hours before the period ends.
- Managing and cancelling. You manage and cancel the subscription in your Apple Account settings, not in the app. Cancelling stops future renewals; it does not shorten the period you have already paid for.
- Free trial. If a free trial is offered on your storefront, the app shows it before purchase. An unused portion of a free trial is forfeited when you buy a subscription. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription.
- Refunds. Purchases are made through Apple, so refunds are handled by Apple under its terms. We cannot issue refunds for App Store purchases.
5. Acceptable use
Use the app for its intended purpose. Do not use it to break the law, to interfere with or overload our service, to gain unauthorised access to another person's account or to our systems, or to circumvent the subscription. We may suspend access that does any of these.
6. AI-generated content
FocusAlly generates nudges and insights automatically, using a large language model. This content is produced by software, is not reviewed by a person before you see it, and may be inaccurate or unhelpful. It is not professional, medical, psychological, legal or financial advice. Decisions you make about your work and your health are yours.
7. Availability and changes to the service
We may change, suspend or discontinue features. Server-side features — synchronisation, insights and push notifications — depend on our service being available and may be interrupted. The app's core function works offline and on-device.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free or that it will produce any particular result.
9. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or lost opportunity arising out of your use of the app. Nothing here limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, and any statutory consumer rights you have.
10. Termination
You may stop using the app at any time by deleting it; that removes the data stored on that device. To have server-side data deleted, write to us — see the Privacy Policy. We may terminate or suspend your access if you materially breach these terms.
11. Changes to these terms
We may update these terms. The current version is always at this address, with the date of the last change at the top. Continuing to use the app after a change means you accept the updated terms.
12. Apple
Apple is not a party to these terms and has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
